What Senior Care Facilities Need to Know About Hot Water and Legionella Prevention

Senior care facilities have unique hot water needs, especially when it comes to Legionella prevention. Hot water is your primary weapon of defense, but elderly residents in long-term care are vulnerable to scalding, so the temperature balance has to be exactly right.

Why Senior Care Facilities Are High-Risk for Legionella

Whether you’re the administrator, director of nursing, facilities director, or compliance officer, water temperature is a critical part of your oversight. Why so critical?

Legionella is one of your biggest threats in senior healthcare. In fact, Legionnaires’ disease has a 25% fatality rate in health care settings, especially in long-term care, assisted living, and skilled nursing facilities. The CDC shows that incidents are increasing, too. Over the past 15 years, there’s been a 300% increase in diagnosed cases. The shocking issue is that 90% of outbreaks are preventable with a proper water management program. Proper water management requires a commercial water heater you can count on.

Legionella flourishes in water temperatures between 77°F and 113°F. This happens to be the same range that building plumbing systems drift into when they’re not actively managed. The bacteria can spread through inhalation of aerosols from showers, faucets, whirlpool baths, decorative water features, and hydrotherapy pools. All of these happen to be common in senior healthcare environments.

Seniors are particularly vulnerable to the issue. Age typically weakens the immune response, and many residents have underlying respiratory or chronic conditions. The risk is compounded for residents who are immunocompromised or those who smoke or have a history of smoking. When these folks are exposed, they have very little defense against Legionella pneumonia.

There are also facility-specific risk factors that can increase your baseline risk. For example, facilities with long, complex plumbing networks and long pipe runs often have standing water in pipes. If you have infrequently used fixtures in guest rooms and therapy suites, water can end up stagnant.

Aging infrastructure also adds to the risk. If water temperatures aren’t consistently maintained through the distribution system, there’s a greater risk. Hydrotherapy pools and whirlpool tubs often aerosolize the water, which requires a specific set of supervision standards.

What the Regulations Actually Require

In 2017, CMS issued a Legionella memorandum. Since then, they have continued to strengthen the expectations for long-term care facilities. The current requirement is that every Medicare-certified nursing home and long-term care facility must have a water management program (WMP) in place. That doesn’t just mean a policy document. They need to have an active, implemented program with documentation.

When surveyors and regulation personnel visit your facility, they will be looking for several pieces of information:

  • A written WMP, specific to your water system.
  • Documented and identified control measures: temperature management, disinfectant level controls, visual inspections, and environmental testing protocols.
  • Documented monitoring and testing results.
  • Designated personnel, identified, who are responsible for implementing and overseeing the WMP.
  • A clear response plan for positive Legionella samples.

Most facilities use ASHRAE Standard 188. This is the industry benchmark and the framework used for building WMP. The nice thing about the ASHRAE Standard 188 is that CMS references it, and any regulators or inspectors will understand it.

Since 2022, the Joint Commission Standard EC. 02.05.02 has been in place. This standard required accredited healthcare facilities to implement WMPs. This standard applies to many senior facilities that hold Joint Commission accreditation.

For organizations, this presents a real risk. If facilities don’t comply, they can face potential loss of their Medicare and Medicaid certification, so it’s a serious existential threat to most senior care operations.

But beyond the regulatory risk, Legionnaires’ disease outbreaks in long-term care facilities can result in litigation, wrongful death suits, and significant damage to your reputation. The bottom line is that a WMP is a compliance requirement, not just a best practice suggestion.

The Hot Water Temperature Dilemma Between Legionella and Scalding

The issue of getting the right balance is truly the main challenge of Legionella prevention. It’s a uniquely complicated issue in the senior care industry.

On one side, you have Legionella. It’s killed at temperatures above 140°F (60°C). CDC and ASHRAE both recommend storing hot water above 140°F at the heater. Once in circulation, the water temperature shouldn’t fall below 120°F (49°C). That means the return temperature throughout the distribution system needs to stay above this threshold.

On the other side, you have a risk of scalding. Hot water at the faucet and showers shouldn’t go above 120°F to avoid concerns about scalding. Elderly residents have thinner skin, slower reaction times, reduced sensation, and, often, cognitive impairment. So even lower temperatures can lead to injury, given prolonged exposure.

Water temperature is regulated, too. CMS and state regulators generally limit point-of-use hot water temperatures to 95°F–110°F for nursing care facilities (vs. 105°F–120°F for hospitals). Some states set even lower limits, so it’s important to check on your state’s requirements.

So how do you keep Legionella at bay, while still preventing scalding? The answer is usually to install point-of-use thermostatic mixing valves (TMV’s).

The recommended approach is usually to maintain water temperatures at 135–140°F at the point of generation (your commercial water heater). Then install TMVs as close as possible to the fixtures. These bend hot and cold water to bring you safe temperatures at the faucet or showerhead. Meanwhile, the distribution system stays sufficiently hot to suppress Legionella. TMVs require routine maintenance and inspection, as valve failure can result in scalding.

Of course, TMVs aren’t always the practical option. For example, if your facility’s fixtures can’t be retrofitted for TMVs, or if your state regulations prohibit higher distribution temperatures. There are alternatives, including perioding superheat-and-flush protocols (briefly raising water temperature above 150°F+ at the point of use for thermal disinfection). Alternatively, supplemental chlorination can also be an option.

Practical Hot Water Temperature Control

For facilities building or updating their WMP, there are a few temperature targets that are important to know.

  • Water heater storage needs to stay above 140°F (60°C).
  • Hot water circulation return requires a minimum of 120F (49°C), or the highest temperature permitted by state regulations.
  • Points of use delivery (with TMVs) need to be at or below the state maximum, which is typically 95°F–110°F for nursing care facilities.
  • Cold water systems below68°F (20°C) also require attention as Legionella can grow at temperatures as low as 68°F.

There are also concerns about inactive sections of pipe, or what’s commonly known as a “dead leg” concern. Sections of pipe with no or low water flow are where Legionella colonizes. Stagnant water sits in the dead legs and stays at temperatures that favor organism growth.

It’s important that low-flow piping runs and dead legs are flushed at least weekly. Infrequently used fixtures such as eye wash stations, guest paths, and therapy rooms should also be flushed regularly per the WMP.

Continuous recirculation (or as close to continuous as possible) prevents temperature drops in distribution lines that create Legionella growth conditions. This is why pipe insulation on recirculation loops is necessary for maintaining temperatures over long pipe runs.

For temperature monitoring, it’s a good idea to deploy temperature sensors at critical control points, including water heater outlets, recirculation loops, cold water supply mains, and representative points of use in high-risk resident care areas.

Your Water Heater’s Role in Legionella Compliance

Your commercial water heater is key in the context of Legionella prevention. It’s the primary control point for the entire hot water system. Your water heater needs to reliably maintain storage temperatures above 140°F and deliver consistent temperatures to the distribution system without a notable drop-off.

Your water heater should support water circulation without temperature degradation throughout your building. It should also recover quickly enough to maintain critical temperatures during times of peak demand, such as morning bathing and shift changes.

Aging units that can no longer sustain consistent temperatures, especially at the far ends of the distribution system, are a compliance risk. Undersized symptoms are also a problem because peak demand can cause temperatures to drop into the Legionella growth range. Single-unit systems without backup are also of concern. If your commercial water heater fails, hot water delivery fails, and temperature control fails with it.

In a senior care facility, a water heater failure is a potential compliance event. Maintaining a temperature above 120°F in the distribution system requires a functioning water heater. A system without backup capacity can’t maintain those important temperatures if the primary unit goes down.
